    In I485 application "Part 2: App Type" Option b (derivative status for spouses and children)
    is actually related to quota listed in INA Sec. 203. [8 U.S.C. 1153] a - 2. (family quota)
    and not to INA Sec. 203. [8 U.S.C. 1153] b - * (employment quota).

    IV Core. Can something be done to highlight this issue in your conversation with authorities ?

    unfortunately more than 80% of backlog elemination is completed, so labor substitution even though it is removed from july 16 has already done its damage. scores of people have already done labor substitution.

    How come they did not stop the substitution right away? Instead, giving it another month. Wish they gave the visa bulletin another month. :cool:

    Thanks for the update. Let me share my concern with the CIR. Do you think that someone (lawmakers) is going to officially vote for the CIR to die? I don't believe so. Discussions, debates, political bickering and fingerpointing can drag on for months and even years because no one is officially willing to kill it for obvious political reasons. How long do you think we (IV) can wait until we start pushing for other bills?

    Good to know that you are still working on that lawsuit ( as a covert operation rather than arguing with other IV ians) but that makes everyone of us feel shaky in joining hands with you in this issue as well.

    The moment (not the day) your interests will get done you will leave hands in this coalition...... Or are you just trying to exploit/leverage someone's 'English writing Skill' or may be use the "IV platform" to use it in own advantage ??

    Look - i've nothing personal with you or against you but i do NOT want to join hands with someone who harbors/nurtures "Divisive Thoughts" in small technical matters like EB2 and EB3 ...

    Gurus,

    I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.

    I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003

    Please help.

    All the points you mentioned are valid and sensible from a business perspective.

    However if someone takes the company to court based on "Immigration Reform and Control Act of 1986" vs hiring an H1B, how can the company legally defend itself against this law ?

    I sent my 485 to NSC on JUL 3rd, my 140 approved NSC, no receipts from
    TSC yet. Does any body got receipts who applied on JUL 3rd...?
    If your 140 Approved from NSC then you should get receipts from NSC. Not from TSC.

    It is depressing to see that nothing has changed much since the last post in this thread in 2007!
    We are still in the same rut :mad: and not a single immigration news to read either :eek: let alone have any kind of active debate on the topic !!

    You are wrong. There have been lot of changes. Two year EAD for one. And how about EB2 category moving to mid 2006 so most of the EB2 people before that have got GC or will surely get it next year. The only thing that hasn;'t changed is EB3 India. It was stuck in 2001 at that time and still is in 2001. It will crawl to 2002 in the coming year but that's that.

    Both and spouse and I received my receipts for our I-485, I-140, EAD, AP 09/19/07. On 09/24/07 we received fingerprint notice and on 09/27/07 we received our EAD card. I am quite surprise by how fast it came. Here are my details :

    Priority Date: 10/15/04
    Type: EB3
    I-140/I-485: Concurrently filing at NSC. Receipt date 07/07/07
    Checks cashed: 09/10/07
    Receipts received: 09/19/07
    Fingerprint appt: 10/09/07

    Fittan
    both me and my spouse also got our receipts for I-485/EAD on Sept 24th. Filed on July 20 (NSC). We received transfer notices (CSC TO NSC) for I-485 on Sept 28th. Received EAD card on Oct 1st. Did not receive FP notices yet. Any idea how long will it take to get the FP notices after receiving all the receipts and EAD card?

    Friends,
    Please give your opinion on my plan.

    Current Status:EB3 PD 08/2004, I140 Approved, Got EAD, Good relations with current employer

    I have no realistic hopes by getting GC by end of next year.

    New employment: Have an offer to start a new job around middle of next year by which 180 days will be complete. New job is very different than current one. Here is my plan:
    1. Don't file AC21, hope that I won't receive RFE since my PD wont be current for a long time.
    2. Change address, but give friend's address in the same city as mentioned on application
    3. Convince current employer to respond to RFE (in case any) positively
    4. May be have an arrangement with current employer to work part time when I start new job. So that way, I'll remain on previous employer's payroll and he can respond to RFE

    Does this sound far fetched?

    Thanks gc28262 for your contributions to this drive. I request others to pitch in as well. We can discuss the nitty-gritties till we bleed. But that won't achieve anything. It will not stop the minformation being spread. We have to collect enough evidence and present it to the media. 4-5 job ads is just the beginning, we need a collection of few hundred to prove this is the prevalent trend.

    I am bringing these out not because I am opposed to equal treatment of folks on H1/ EAD etc - but because there are legitimate arguments both ways and unless we can prove unequivocally that there is gross miscarriage of justice in denying us this right and on the other hand - there is no disadvantage caused to anybody else by granting us this right - this idea is unlikely to see the light of the day

    while i am happy to be proven wrong - i do not see anyone in this forum having a stomach for a protracted legal battle starting with lower courts and going all the way to Supreme Court - going back to my previous point - we do not see this as a "larger than me" cause

    Incorrect words used by me, I did not mean that supreme court gave authority, but that supreme court did not find that discrimination based on country of origin for immigrants violates the basic tenents of this countries constitution.

    I am not saying that this is a case on employers. If at all it would be a case against the discriminatory laws of the congress which allow someone to stay indefinitely but, do not allow them to work.

    If a case like this is filed, I do not think, I do not see it going to be a proteacted battle. If enough coverage is given, the lawmakers might sit down and fix the problem or atleast have a quick temporary fix. Maybe even lawmakers might not be needed, just the DOJ would might update the rules (which it is allowed in case it determines that the laws are conflicting). Most important of all, this will bring the issues on the front from being a laggard.

    I mailed mine on May 25 and up to now I haven't gotten anything yet. My lawyer mailed it to NSC and since my I-140 is pending with the TSC, my lawyer said they will just forward it there. It's taking too long. Anybody in the same boat as I am?
    I was under the impression that you cannot file before June 1st..

    Over the past 4 years, I have contributed to IV several times. I was also a monthly subscriber of $20 for over a year until my credit card expired and the payments stopped.
    What pains me is that inspite of several requests, i have not been granted access to donor forms. Perhaps there is a waiting list for donor access or my priority date is not current for the same.:confused:

    I will try my best to make it to DC events, but please accept my small contribution in case i am unable to make the trip.
