    Madam Rice is trying to divert the issue by telling skilled professional from all over the world wants to come here....This is not the issue.....

    Issue is there are thousands of high skilled professional with approved labor and I-140 , waiting for years to file I-485.... DOS told then on 13th June that you all can file I-485 and all of the sudden on 2nd July 07 DOS said we can't accept your application...

    So madam secretary it's not issue of how many high skilled professional wants to come here. Infact DOS/USCIS/Govt. of US need to think how life is tough for those high skilled professional who already came here and waiting for years to get green card through legal system....

    As much as all of us on this board would like to get our GCs, remember that GC is just a means to an end, it is not the end itself. Dont make the GC so important that not getting it starts "depressing" you.



    if you see life as a series of choices and actions, then the lack of GC inhibits a lot of choices and actions.

    how badly you wish to change career for example, varies among individuals. but one should not forget that life is finite number of years, and the system here wants to eat all your productive years by dangling the GC carrot.

    as sufferers of this ordeal, i believe it is our duty to inform the young and innocent who are not yet in this mess, about the future that awaits them.

    mind you i am not discouraging anyone from coming to the US.. that is a decision that must be made by the individual.... just making sure the rules and realities of the game are known to people before they come here.

    Congrats to all who are PRs now!

    After CPO e-mail, card arrives within 10 days.

    Chain of events are not consistent but usually at 1or 2 days interval, approval and welcome e-mails are seen as hard LUDs.

    I-797 notice of approval is enough to go to district office and have I-551 stamp in passport. This is the proof of GC.

    Enjoy, do not worry and relax!

    Are you an desi employer by any chance?. Just wondering�

    Also I agree with most of what kshitijnt says but why should somebody apologize even after he has placed 4 employees and has worked for 2 years. He did not leave within couple of months for crying out loud. Some of the desi employers are so greedy and unethical that even after you slog with them for years, they still want to hold on to something just to prove they are employer/boss. This is a lesson for people wanting to help their employers business. I would tell them that it is none of their business to help their employer�s business.



    Yes I agree with you, Some are really nastly dont give anything in writting , Dont even apply for H1b until you force them when they hire you on OPT, I have seen some of my freinds had to go back to India because of them. They are to be taugh a lesson, If we are immigants they are too.

    This is true. A majority of the Dems are sensible people. BTW, although they are against outsourcing, they are not against immigration. The two issues are quite different.

    Americans and agencies generally better understand the language of lawsuits. Polite requests and working with congress does not make sense to them.

    what you are hoping for is a change in law which one cares about because it is absurd.

    Atleast we agree on one point that the law is absurd.

    Just a thought.

    If the worst was to happen how do the USCIS know your wife is now on her own? If you have an H1B visa that has some years to run on it then this would buy time to get I485 approval.

    Once the approval comes through what is to stop the USCIS issuing one to you as well as your wife.

    If nobody tells the USCIS then the wheels will continue to grind along anyway.

    Just a thought.

    The point system has worked well in both Canada and New Zealand and have moved those who meet the threshold through the immigration system faster. As an non paying IV member, I am not in favor of opposing the current bill.


    Where did you get this idea that IV is opposed to the point system? Any reference to the IV analysis or the core member response would be appreciated before you put such a claim.

    We have identified our objectives clearly. Taking a position for the bill (in favor of or in opposition to) does not neccesarily mean that we want to kill this bill, but instead we like the congress to treat this community fairly and at parity with the undocumented immigrants and family-based applicants in the current Immigration Reform bill S. 1348.

    Correct me If I am wrong

    out of 45K members let's assume 22.5 K are EB2 and 22.5 K are EB3.

    Even If 11.25K (EB2)+11.25K (EB3) = 22.5 K (Total) contributes $25 Each Problems gets solved ... but the catch is ....

    Even 11.25 K EB2 members are not contributing because they don't have to as their problem is solved

    Even 11.25 K EB3 members are not contributing because they are not sure even with this contribution their problems gets solved.

    Many people are saying that EB3 members are not contributing that's why you are lagging etc...

    EB3 Members who contributed are feeling the pain because even after contribution they are not getting the results and EB2 members who didn't contributed are getting the results...

    Let's assume EB3 at 11.25K. They all know that their are royally screwed unless there is legislative action. So, I would expect 11.25 K EB3 to be at the front of this funding drive. Let's face it EB2 will likely become current sometime in 2012 (per Q and Teddy in other thread), no one is ever predicting this to happen for EB3 barring law change. IF you are in such a big hole, you will have to come forward and work for yourself. We want others to work for us and solve our problems. That is my issue here. With 11.25 K EB3 members we would have still collected quarter million bucks.(@ 25$/person) If EB3-I does not care for itself, why would anybody else give a damn? (PS : I did contribute for the drive as I want everybody's issues with respect to GC resolved, not just mine)

    So, the original post still stands true.

    This guy is a deshi employer. He is on H1 so he is a silent partner & that why scratching his head.

    There are attorneys who will charge only after recovering money. The stupid employer can be sued for lost wages along with civil penalties from which the attorney's fee will be paid.


    You can view my past posts in IV, I am not Desi employer but I may become very soon to employ myself (very close to get GC :-) )

    Anyway have you gone through yourself with same situation/tension as OP going through or do you know someone closely who have gone through? Have you dealt with attorney yourself?


    If that employer sue you, definitely you can counter sue for violation of wage related or h1b related rules and attorney will be the best person to advice you on that. make sure you go to an attorney who practice employement laws and have knowledge or have some other attorney in the same firm who deals in immi related matter. But question is, do you want to go through nightmare of law suites or you just want peace of mind.
