my EAD is still pending. but no lud on EAD cases. just a soft LUD on I-140 on 7/13. Very wired !!

Honestly, I did not understand jchan's scenario.
AFIK, none will get affected. Please look for my earlier posts regarding I485 Derivative application pre-requisites.
I am waiting to hear from IV-core's or forum-attorney�s interpretation.
Chan is right. If interpretation will start the way you are proposing, it will be sheer disaster for people who didn't file I-485 yet.

The relief for EB3 comes because a lot of EB2's/EB1's will be gone from the quota. So, if the queue is smaller, you get it faster. The way I look at it, we want the queue to be smaller.

Also, if you have an advanced degree from an acredited university outside US AND have been working for 3 years in a related field, you will also be exempt from the cap regardless of whether you are applying/have applied in EB2 or EB3 (believe me...you would think that people with advanced degrees would have applied in EB2...but there are cases where people have had to apply in EB3 category even with an advanced degree).

Congrats! Can you please tell us where your I140 was approved from. Are the checks cashed?
My I140 is pending with NSC since Jan 2007. My attorney issued the checks, So I don't know whether the checks cashed or not.

Please write a letter to CIS Ombudsman and they will open a case with USCIS to follow up and it will have results. I have done it once and I got the response from USCIS faster.

My lawyer sent I-485 docs to Vermont Service Center, UPS tracking number shows they received the package on 5th June but No receipt or No checks cashed yet.

so what is your point? i have no doubts that i can prove point 1, 2 and 3 below... i.e. real business, planned business (with only me as the employee), contracts and orders. i dont think anyone here is talking about a non-bonafide job with a "paper shop" (in your words)...
what is your point about ? doesnt that sounds like "ability to pay" issue? if yes, that is not an issue at I-485 stage... the yates memo clearly states this...

Last year we ran a High Five Campaign and collected $4883 over a period of 4 months. It was a disappointment.
Now as we know the environment is very volatile and lot of things are going against LEGAL Immigrants i.e US (TARP Employer H-1B Restriction Bill (Sanders Bill)), i will like to request everyone to contribute as much as they can. I will like you to contribute a minimum of $20 dollars.
ALL you need to do is write out a $20 cheque and send it to IV on the address listed.

All checks cashed June 8th. It was sent to Nebrasks. I hardy just could read the SRC letters in back of my check. Online image in not good. I guess it has gone to Texas sercice center.
